If Jackson hadn't bothered to sue Carvin way back in the 80s for the mirror image Rhoads ripoff, then what the hell does Gibson think they're doing.

To be fair though, until Gibson or a non Kiesel party confirms this is happening we have no way to know what is really happening.

Like that time that Jeff Kiesel made this huge drama about how someone had broken into the Kiesel factory and stole 13 of the greatest Kiesels ever in what could only be considered the most heinous heist of the century and he was offering rewards for Kiesel fans to take justice into their own hands....

.......and then it came out that by "broke into the Kiesel factory and stole 13 of the most premium Kiesels in a daring heist" Jeff Kiesel actually meant he willingly sent 13 Kiesels to a sketchy European distributor who never paid him, which is not exactly the same thing as a heist at the Kiesel factory.

Or, for that matter, that time Jeff Kiesel made an instagram post bragging about how he was banned by every airport car rental agency under the sun from renting cars because he was "too badass". And then it was revealed that by "too badass" Jeff Kiesel meant that he was on the "do not rent to" list at a number of airport car rental agencies owned by the same parent company because he had a history of returning them with the seats covered in shit and fast food wrappers, which is not exactly the same thing as being "too badass".

So it's possible since that the only announcement that Gibson is suing Kiesel in what could be the legal case of the century comes from Jeff Kiesel, it might mean this is another zany Kiesel scheme to create drama and look cool and that is not exactly what's happening.

The more Gibson engages in ridiculous lawsuits the more likely it is they'll lose their control over these shapes, which is really a win for everyone. There may be a very bright future where ESP brings back the MX because Gibson screwed up and lost the Explorer design.

I honestly thing Gibson's strategy is to send these letters off to any "small" manufacturer that makes something that REMOTELY resembles their designs in the hopes that such a company gets scared by the "big guys" and succumb to the requests. However, if such companies just ignore it, I don't think Gibson would pursue any further because even they know they have no case. Its all a bluff.

This is a tough one. I don't know who to root for. Is it possible for both to lose?
Maybe it stays locked up in the courts for years and both have to halt production until it;'s settled?

I have a hard time seeing how Gibson has a claim here... But Jeff Kiesel comes across as such an arrogant dumbass, that I could see him somehow torpedoing his case.

:bump:

So apparently Kiesel sent a cease and desist letter over the guitar in this thread: https://www.metalguitarist.org/foru...2-harley-benton-dullahan-headless-models.html

"I did send out a cease and desist letter this week to a company that is making an Osiris direct rip-off. It is a company that has been trying to carry my guitars for a long time and I keep telling them "no" every year. And, they went ahead and decided to rip my guitar off. So while we are standing strong against the Gibson thing because it is unfounded and they don't have a leg to stand on.

I do believe in trademarking and design patenting your product, your idea, and putting that out there right away rather than letting the market kind of have their way with something and then trying to defend it. So I did send out a cease and desist letter - or my attorney did - this week for a company that was copying this. I'm sure somebody will throw that link up there - I don't want to mention that company here or mention any names - but they have probably gotten it by now.

It was sent by email and also certified mail. So yeah, I am going to defend anything I have, my design patent. The numbers are up on my website. You can see the patents and patent pendings. So even once it is patent pending you are still fully protected."

Kiesel burns through the infinitesimal sliver of sympathy they may have got from some people after the Gibson news in record time.

I actually googled the Osiris, because I have no idea what the actual range of model is, and it's kind of pathetic that Kiesels precious IP they are defending is essentially just a really ugly Steinberger clone.

Yeah it's a really lazy single cut headless. Looks like an obese Wolfgang.

It's just, like, literally the most Jeff Kiesel-ish response to a Gibson lawsuit. "Hey, if they can do it, we can do it too!". Brilliant!

Read on FB that Kiesel had sent a Cease and Desist letter to Thomann because of their new Headless guitars. Haven't found confirmation if true.
